Suspect in deputy's death was recently released from jail

LAURENS, SC (FOX Carolina) -

The man accused of killing a Laurens County Deputy on Wednesday night had been released from jail within the last two weeks, according to Laurens County Sheriff Ricky Chastain.

Chastain said Benny Ray Brown, Jr. killed Deputy Roger Rice during a shootout on Barrel Stave Road in Clinton.

Investigators said Brown shot and killed his girlfriend outside the Fehrer Plant in Fountain Inn earlier in the night.

Chastain said Rice was called in to help search for Brown.

Brown's arrest record dates back about 20 years in South Carolina. 

The record shows the following arrests in Benny Brown's past:

April 1990: Simple assault charge

May 1990: Burglary and grand larceny charge

April 1992: Violation of parole charge

March 1993: Driving under suspension charge and no child restraint charge

February 2002: Criminal domestic violence charge

August 2005: Criminal domestic violence charge and malicious injury to personal property charge

June 2011: Criminal domestic violence charge

According to Chastain, Brown had been released from jail on bond after the most recent arrest on June 30 on a criminal domestic violence charge.  Brown was released on July 1.  

Deputies said that the woman Brown is accused of killing on Wednesday night is the same woman who was the victim in that criminal domestic violence case on June 30.

Brown is in the hospital after being shot at the scene on Barrel Stave Road. He will be taken to jail after he is treated.

On Thursday morning, Chastain, who was visibly distraught, told FOX Carolina, "If he was in jail, we'd have two people alive this morning."
