Judge orders Ludwig to prison for 3 years

GREENVILLE, SC (AP/FOX Carolina) -

A South Carolina man who avoided prison in a 2009 car crash that killed a Greenville homeowner is going to jail for three years. 

A judge on Friday revoked 39-year-old John Ludwig Jr.'s probation and sentenced him to serve three years of an earlier five-year suspended sentence. 

The once-wealthy businessman was charged with criminal domestic violence in November. Ludwig's wife told police her husband hit her in the back of the head as she tried to take a bath. 

Ludwig was still on probation as part of a guilty plea to reckless homicide when he was arrested on the domestic violence charge. Ludwig was originally charged with murder after his Maserati hurtled through a field, launched off an embankment and plowed into Frederic Bardsley's home, killing the 62-year-old homeowner as he sat watching television.

Ludwig was also charged with probation violation on Nov. 7, 2011, according to the Greenville County Detention Center's website.

That arrest came after Ludwig was charged with criminal domestic violence and released on $15,000 bond.

Ludwig's wife said that he only touched the back of her head to make a point. She said she did not call the police.

In the report officers said she did not want Ludwig to go to prison, but wanted documentation of the incident to aid her plans to divorce him. She tried to minimize the slap to a touch, according to officers.

On Nov. 7, a spokesman for the Probation and Parole Department said warrants for Ludwig's arrest in connection to the probation violation charge were signed the same day that he was arrested in connection with the most recent criminal domestic violence charge.

The spokesman said Ludwig's attorney was notified of the warrants. He said Ludwig was given the opportunity to turn himself in, which he did. The judge gave Ludwig a $10,000 bond.

On Friday, Ludwig's attorney said they were completely surprised by the outcome of the sentencing.

Ludwig was convicted of criminal domestic violence against his previous wife in February 2010.
