Charges dropped in 2009 fatal shooting

Charges against a man arrested in connection with the shooting death of a Spartanburg County woman three years ago have been dropped.

Investigators have said that about 12:30 a.m. Oct. 21, 2009, someone drove by a home on Tacco Court and opened fire, killing 45-year-old Joy Mack. They said Mack, who was visiting her son at the time of the shooting, was not the target, and was just in the wrong place at the wrong time.

Four months later, Monquez Fowler, of Inman, was arrested in connection with Mack's death.

Prosecutors said that on May 20, 2011, the charges against Fowler were dropped because of insufficient evidence.

"Prior to dismissing the case, we met with four to six member of the Joy Mac family, and explained the legal challenges associated with the prosecution," said prosecutors said in a statement. "The case has been returned to law enforcement for more investigation, and we are hopeful someone will come forward with new information."

Jannie Butler, Mack's aunt, said she is only interested in finding the truth behind who killed her niece.

"When they find somebody for the murder of my niece, I want it to be the right person that is going to jail," Butler said. "I don't want it to be some innocent person."

Butler said that some members of the family don't agree with the decision to dismiss the charges against Fowler.

Fowler declined to comment.
