Man says neighbor shot at him, kids while fishing

PACOLET, SC (FOX Carolina) -

An Upstate man said he went fishing with a friend and some kids but was interrupted when the pond's property owner fired shots at them.

James Ely said his neighbor opened fire on him and his fishing group that included three small children, and he is upset because she does not face any charges.

Ely said he has fished in the pond behind his home on Glenn Springs Road in Pacolet two dozen times without any problems - until Sunday.

"We heard a shot whiz over the tree line over our heads and we yelled there are kids down here and there were two more shots," said Ely.

After the shooting stopped, Ely said he confronted his neighbor who fired the shots.

"I told her there were kids down there and she said I don't give a d*** who I hit," said Ely.

So Ely called deputies who investigated the shooting and took the case to a magistrate judge who denied signing arrest warrants because Ely and his group were trespassing.

Ely said he did not even know the property belonged to his neighbor and said a no trespassing sign was put up after the shooting. He said if she had asked, he would never have returned to fish.

Ely said he is glad no one was hurt, but he is worried that the decision not to arrest someone who fired on a group of fishermen sends the wrong message.

"If you're gonna shoot anytime at anybody then ask questions later, we aren't in the wild, wild west," said Ely.

FOX Carolina was unable to reach the neighbor who fired the shots for comment and calls to the magistrate's office went unanswered.
