Greenville firefighters sue district for back pay

GREENVILLE, SC (FOX Carolina) -

A group of firefighters who work for Parker Sewer and Fire District have sued their department claiming it owes them back pay.

The lawsuit was filed in Greenville County. Originally, four firefighters joined the suit, but now more than a dozen have joined the case.

David Rothstein, the firefighters' attorney, said the problems came to light when pay procedures recently changed. He said the changes showed the firefighters were not properly paid for overtime in the past.

Rothstein said they believe the firefighters, some of whom still work for the district, are entitled to two or three years of back pay for the overtime.

"If they got interrupted in the middle of the night for a call or they had to come back to cover for somebody on their day off or if they participated in National Fire Prevention Education Week, they weren't paid any additional money for that," said Rothstein. "Under the new plan, they are paid hour for hour for every hour they actually work."

In the past, when firefighters worked 24 hours and had two days off, they say their pay was deducted eight hours for sleeping and two hours for meals, but they often worked during those times too, Rothstein said.

Rothstein said it is not clear how much they might be owed. The Parker District declined to comment about the lawsuit.
