The son of a Smith County Sheriff's Office investigator and a former Smith County 911 dispatcher has been removed from his family's home.
The investigator and his wife were arrested last week for failing to report the sexual assault of three children. According to an arrest warrant affidavit, their 15-year-old son is accused of sexually assaulting his siblings and a classmate. Those siblings are in the custody of their parents, who are out of jail on $7,500 bonds.
An affidavit states that some of the assaults reportedly took place at school, both on a school bus and in the bathroom of a school band hall. While the address where some of the assaults happened is within the Arp Independent School District, school officials could not confirm if the accused was one of their students.
The district says they are not personally investigating any instances of sexual assault. Superintendent Toney Lowery says law enforcement has been in touch with the high school principal regarding an investigation, but he could not confirm if that investigation had anything to do with the alleged assaults. He did say, according to state law, in any situation where a student is accused of a violent crime, that student will not be allowed around the other students.
According to the arrested investigator's Texas Commission on Law Enforcement Officer Standards and Education information (TCLOSE), he has completed 1,286 hours of law enforcement courses. Thirty-six of those hours include juvenile justice procedures, sex offender registration training and child abuse prevention and investigation.
The failure to report child abuse or neglect is a class a misdemeanor. If convicted, the investigator and his wife could face one year in jail and a fine of up to four thousand dollars.
