Pinal Sheriff Babeu blasts president Obama in letter

PINAL COUNTY, AZ (CBS5) -

Pinal County Sheriff Paul Babeu is upset with the president. He sent a letter telling the president that he did not agree with his proposed gun legislation and would not be following them if passed.

"Surprise I haven't received a response by the president or anyone on his administrative staff," Babeu said.

In the letter, dated Jan. 16, the sheriff tells the president, "it's not the gun that's at fault but rather the criminals who use them."

He goes on to tell the president that there is a process that must be followed before something becomes law and that as a Constitutional attorney he should know better.

The letter goes on to say, "You are not a dictator or a king, who can act unilaterally and ignore our legislative process of law making."

Even though the president's proposals have not been passed, the sheriff has told his staff as well as the president that he will not follow them.

"I am writing you this letter today to inform you that any 'law' or regulation created by an executive order of your office which is contrary to what the Constitution of the United States of America says, shall be deemed as unlawful and not be carried out by myself or my office," he wrote.

Babeu says he sent the letter not only in written form, but electronically as well. He welcomes a response by either the president or his staff. 

There is one mistake in Babeu's letter, however. He spelled the president's name wrong. It is addressed to "Barak" instead of "Barack" Obama. CBS 5 News pointed out the misspelling to Babeu's spokesman, Tim Gaffney, who replied, "Ugh...Thanks I can't wait for this week to be done..."
