Driver charged after woman hit by car in Madison

NASHVILLE, TN (WSMV) -

The husband of a woman struck and seriously injured by a car as she walked in Madison last week said the driver sped up right before she was hit.

Police said Gregory Capps, 43, was driving a 2004 Chevrolet Suburban when he struck and critically injured 52-year-old Theresa Lawton in the 100 block of East Marthona Road on Jan. 30.

Capps said he didn't see Lawton, who was taken to Vanderbilt University Medical Center for treatment, but a field sobriety test indicated that Capps was impaired.

At a hearing Tuesday, Richard Lawton spoke of the night his wife was hit. He said he and his wife were crossing the street for a weekly church group meeting when the incident happened.

"When we saw the car turn, we continued to cross. Then I heard the car rev the engine as if it was speeding up," Richard Lawton said.

Metro police officer Christopher Augustine administered a field sobriety test for Capps.

"Yes, I did notice a strong odor of alcohol from his exposed breath," Augustine said.

A grand jury will decide what happens next for Capps, who faces charges of felony vehicular assault and driving on a revoked license.
