FOUNTAIN INN, SC (FOX Carolina) -

An Upstate couple was reunited with the dogs they thought they might lose after they were taken from the couple's ownership last week.

David and Krista Painter's dogs Lola and Sara got out of their fence last week. The Painters said they believed someone kicked in their fence, letting the dogs out.

When Fountain Inn animal control officers arrived, they found them in a front yard and though Sara was a threat because she had escaped once before, the Painters said.

"They shot her with a tranquilizer gun and chased her a mile or so down the road and got her," David Painter said.

Lola ran away and hid until the Painters found her and took her to a relative's house in another Upstate county.

David Painter said animal control officers made them surrender the dogs because they deemed them vicious and didn't want them biting anyone. In the meantime, Sara was being held in a kennel by animal control, though the Painters said their dogs had never bitten anyone.

The Painters went to the local magistrate's office on Tuesday where they reached an agreement with the city of Fountain Inn that the couple would keep their dogs if they paid a $200 fine and agree to move both dogs out of the city limits.

"It's OK because all we care about is the dogs and not having her sit in a kennel for a year while we wait for a jury trial and not die, be killed," said the Painters.

The dogs will live with a relative in another Upstate county while the Painters plan to put their house up for sale and move out of the city limits so they can all live together again soon.
