Game developer fights Rutherford Co. land condemnation

RUTHERFORDTON, NC (AP) -

A video game developer in Cary is fighting a move by an electric cooperative to run power lines over his land in Rutherford County.

Tim Sweeney is trying to stop Rutherford Electric Membership Corp. from running 12 miles of power lines across his 5,300 acres of forest land.

Sweeney says the Rutherford County court clerk improperly named a three-member panel to consider the condemnation of the land. Sweeney says that was improper because part of the land is in McDowell County and none of the three members of the panel are from McDowell County.

The utility says that's not necessary.

The panel said the land is worth about $72,000. Sweeney says he'll lose more than $10 million in value if the power lines run through the land.
