Asheville Police said no charges will be field in the crash that killed a 1-year-old boy on Saturday.
The crash happened on West Chapel Circle just after 3:30 p.m., police said.
The victim, Lucious Bernard Sullivan III, ran into the roadway and into the path of a Jeep Cherokee, which police said had just turned onto the road.
"The child hit the front right corner of the Jeep Cherokee causing his left foot to be run over by the front right tire." Said Sgt. Dave Romick. "This caused the child to go onto the pavement which caused internal head trauma."
Romick said the driver stopped just after the crash, contrary to what family members initially reported.
The family initially reported that the driver didn't realize he had hit the child and that family members had to chase him down to get him to stop.
"The investigation has revealed low speeds upon impact, approximately 15 - 20 mph, and the child was not drug by the vehicle," Romick said.
Romick said police consulted with the Buncombe County District Attorney's Office and determined that no charges will be filed in this incident.
Sullivan's family said the boy was at the home on West Chapel Circle attending a child's birthday party.
