Wake Forest man Tased twice by police after resisting arrest

 Wake Forest police Tased a 20-year-old man twice Wednesday after he resisted arrest.

A call reporting gunfire in the 600 block of East Pine Avenue was made Wednesday evening, police said. Responding officers found around 50 people in the area.

Sgt. C. Minor observed Theron Elijah Gill, 218 Seventh Street, Wake Forest, using abusive and vulgar language, police said. Minor told Gill he was under arrest after warning Gill to stop using abusive language.

Gill refused to comply with Minor’s request and was Tased by Officer Albert, police said. Gill still resisted arrest while on the ground and was Tased a second time, police said.

Wake Forest Police Chief Jeff Leonard said Gill was not Tased for his language but for resisting arrest.

“After ignoring repeated warnings he was arrested for disorderly conduct. He was then instructed to put his hands behind his back. Again, he refused to comply and when he continued to resist, he was tased,” Leonard said.

A cell phone video taken by a bystander captured the incident. The bystander tells police Gill’s freedom of speech right was being violated.

Police said the First Amendment does not protect against “punishment for use of insulting or fighting words that are likely to cause an immediate breach of the peace.”

“Just as you can’t yell ‘Fire’ in a theater or ‘Bomb’ on an airplane, citizens should recognize that they can’t use language in a public setting that threatens peace and order and that’s precisely what Mr. Gill did repeatedly,” Leonard said.

Gill was taken to the Wake County Jail and charged with disorderly conduct by abusive language and resisting, delaying and obstructing a public officer. He given a $3,000 secured bond, police said. He posted bond later.
