Tuskegee VA employee appears in court for sexual assault case

A Tuskegee VA hospital employee was brought into a federal court in shackles on Tuesday.

The defendant, Eric Allen, is accused of sexually assaulting a hospital volunteer who suffers from Down Syndrome.

The veteran affiliated with the Tuskegee Hospital, is charged with sexual assault and remains behind bars. There is no word yet if that will remain the case in the long run.

Judge Charles Coody will continue Eric Allen's case until Friday. Despite video and audio recordings of the victim, the judge said the prosecution did not prove the level of mental disability of the victim.

The court heard the victim respond "no" when asked if she wanted Allen to touch her.

When police asked Allen if he touched the victim, he said not anymore and apologized, admitting it would have likely gone further if the victim did not suffer from a mental disability.

WSFA 12 News did learn that Allen receives treatment and housing from the VA in Tuskegee.

Friday's hearing will determine if he will continue to receive that treatment, or remain behind bars.
