Lawsuit filed against man who shot, killed 'prowler' in Anderson

ANDERSON, SC (FOX Carolina) -

The mother of a man shot and killed by an Anderson County homeowner who told investigators he was firing at a prowler has filed two lawsuits against the shooter, according to her her attorney.

Attorney Tom Dunaway said the lawsuit was filed Tuesday against Marcus Brown on behalf of Jo Pickens.

28-year-old Leandus Pickens of Columbia was shot and killed at a home on Greenland Road in Anderson.

The homeowner told investigators he fired on an intruder that had unlawfully entered the home through a window.

The family said Brown knew that Pickens would be visiting him and that the men knew each other well.

The two lawsuits include a wrongful death suit which alleges that Brown "negligently and recklessly discharge(ed) a firearm." The second lawsuit, a survival action suit, states Brown "failed to exercise due care" before shooting Pickens.

Each lawsuit seeks $10 million in damages.
