Report: Woman arrested in Henderson Co. after intentionally setting outdoor fire amid burning ban

A woman was arrested in Henderson County after deputies determined she intentionally set an outdoor fire amid an active burning ban, according to a report.

Henderson County deputies and Blue Ridge Fire and Rescue personnel responded to an address on the 100 block of Victoria Drive in East Flat Rock after reports of an illegal burn on Tuesday.

When deputies and fire crews arrived they noticed a small outdoor fire which the firefighters extinguished, said the report. Deputies then determined it was intentionally set by 56-year-old resident Evangelina Rodriguez, according to the report.

Before deputies could question Rodriguez, she reportedly fled into the back of the home.

Deputies said they then obtained warrants for Rodriguez intentionally lighting a fire, which is a violation of the active burning ban, and returned to the home to arrest her. When they arrived, two deputies were assaulted by Rodriguez, the report states. The deputies, nor Rodriguez were injured.

According to the report, Rodriguez was charged with the following:

  • Misdemeanor open burning when prohibited
  • 2 counts of misdemeanor assault on a government official
  • 2 counts of resisting a public officer 
  • Failure to appear on an unrelated misdemeanor assault charge

She is being held in the Henderson County Jail on a $4,700 bond. Her next court appearance is Dec 1.

The Henderson County Sheriff wants to warn anyone violating the current burning ban of the risk of being charged with a class 3 misdemeanor in violation of N.C.G.S. 106-944 for intentionally starting a fire.
