Deputies: Spartanburg woman calls deputies after son spit in her face

A Spartanburg County man was arrested after deputies said he trashed his mother's bedroom and then spat in her face on Tuesday. 

Deputies reported that the mother, Tonya Yearick, said she had given her son an eviction notice, he became angry and then began to tear up her room and spit in her face. Afterwards, she called 911.

Deputies said Yearick stated that the spitting was intentional as she heard an audible indicator of Damien Isham, her son, gathering spit in his mouth prior to being spit on. They said Yearick pointed to her shirt where there was a fresh wet streak and stated that was from the spittle.

According to the Sheriff’s Office, Yearick presented a blank 5-day trespass notice document that is commonly issued prior to the official eviction notice being served. Deputies said Isham stated that he became angry because he believed the eviction paper was fake due to not being notarized.

Deputies then explained that the paperwork was preliminary for the eviction and was legitimate. They said Isham stated that he had kicked the door in and tossed Yearick’s room around because that was what her boyfriend would do to his room, he then declared the police wouldn’t do anything about it.

Deputies said Isham stated he did it to get back at Yearick for the previous times that it was done to him.

According to deputies, Isham stated that he did spit on Yearick but it was unintentional, he stated that it was a by-product of his shouting out.

Deputies said the amount of the alleged fresh spittle on Yearick’s shirt appeared to be of a greater quantity than would be reasonably be expected from a stray spittle from shouting.

Deputies stated the mindset of Isham, quantity of alleged spittle present on Yearick when they arrived on scene and the corroborating statements that Isham had audibly gathered spittle in his mouth to find probable cause for a charge of assault and battery 3rd degree against Isham.

They said the alleged spittle present on Yearick’s person and the timeframe provided by all persons on scene provided evidence that it was freshly committed.

According to the Spartanburg County Sheriff’s Office, Isham was arrested, transported to the detention facility and booked him in without issue.
