No decision after Bucks Racks and Ribs hearing

At a hearing on Friday, a judge declined to rule on an injunction sought against Greenville County by restaurant Bucks Racks and Ribs.

Greenville Bistro LLC, the parent company of Bucks Racks and Ribs, filed a lawsuit on May 24 calling for a temporary injunction. The lawsuit argues that the county and Sheriff Will Lewis are violating their First Amendment rights and hurting their business.

Luke Lirot, the attorney for Greenville Bistro, argued Bucks Racks and Ribs is a successor leasee to the property and therefore grandfathered into the 2002 court order involving Elephant Inc., the owner of Platinum Plus, which specified what meets the criteria of a sexually-oriented business. Lirot said the order applied to the property owner, which now rents the space to Greenville Bistro.

Lirot said the conduct of law enforcement in Greenville County have scared away business and performers, resulting in loss of income.

Scott Bergtold, the attorney for Greenville County, said at the hearing that witness statements indicate the establishment is not operating legally within guidelines for a restaurant.

Undercover deputies reported seeing dancers exposing themselves on stage at the restaurant. In one affidavit, an undercover deputy said a dancer simulated sex acts underneath her bikini top and bottoms.

"These folks came in and got a permit to operate a restaurant, but basically started operating a strip club in violation of the county's laws," Bergtold said.

The judge did not rule on a decision but instead said Greenville Bistro must prove the claim they've suffered irreparable harm.
