UNION, SC (FOX Carolina) -

A Union police officer was arrested on Monday in an incident that the police department said was unrelated to the officer’s employment.

Police said Officer Mark A. Smith was charged with assault and battery first degree.

According to the affidavit for arrest filed by the The South Carolina Law Enforcement Division, the assault happened on December 27, 2016 and involved a female victim who was cleaning his house. Smith is accused of kissing and groping the female against her will . SLED said the woman provided agents with text messages that mentioned the incident.

The arrest warrant states Smith touched the private parts of the victim without her consent and did so with lewd and lascivious intent.

The Union Police Department said Smith was suspended without pay pending the outcome of the case.
