Estate sues YMCA, Housing Authority in 2015 drowning death of Union child

UNION, SC (FOX Carolina) -

A lawyer representing the family of a 7-year-old girl who drowned in the Union County YMCA swimming pool in 2015 has filed a lawsuit against the YMCA, three YMCA employees, and the Union County Housing Authority.

Miracle Smith died in July 2015 while visiting the YMCA with the Union County Housing Authority’s summer camp.

The lawsuit, filed on July 12, 2017, seeks compensation for wrongful death and survival damages.

The lawsuit alleges that the Housing Authority did not require the YMCA to test the children’s swimming abilities before allowing them in the pool, and that Miracle, a “non-swimmer,” was not provided with a personal flotation device.

The lawsuit outlines what can be seen on surveillance footage of the incident, and states the drowning took place in a lap-pool in about 4-feet of water. The lawsuit claims another child rescued Miracle from the bottom of the pool and two other children pulled her out of the water. The lawsuit claims that a YMCA lifeguard delegated CPR resuscitation efforts to a passerby without knowing that person’s CPR qualifications.

The lawsuit also claims that the YMCA was negligent and failed to meet responsibilities under state law regarding public pool operation. The suit claims the YMCA did not properly train and manage lifeguards, make sure they were equipped with life-saving apparatuses, and other alleged shortcomings.

FOX Carolina reached out to both the YMCA and the Housing Authority for a response.

Robby Littlejohn, the executive director of the Union County Housing Authority said he was aware of the lawsuit did not have a statement as of Wednesday morning.

A spokesperson for the YMCA said they could not comment on pending litigation.
