Solicitor: No charges in deadly Greenville County officer-involved shooting

Solicitor Walt Wilkins said after a review of the SLED investigation into a Greenville County officer-involved shooting, no charges will be filed.

On Nov. 29, 2017, deputies said a pursuit was initiated by a suspected intoxicated driver. Deputies pursued the suspect, 27-year-old Jacob Paul McCarty of Landrum, and said he later intentionally struck and disabled a deputy's vehicle.

When the vehicle stopped, deputies said McCarty presented a firearm and although they attempted to negotiate with him, gunfire was exchanged.

McCarty suffered a fatal gunshot wound to the torso.

After a detailed review, Wilkins said evidence supports a finding that the deputy acted appropriately under the circumstances.

Sheriff Will Lewis with Greenville County Sheriff's Office spoke with FOX Carolina on Thursday, and shared some thoughts on the case.

"Sometimes when we see one person that's gone off the rails in such a way and they become a threat to the community, we have an obligation to protect -sometimes even if it's against themselves," said Lewis. "In this case, I'm in no way surprised that this was handled the way it was by the solicitor." 

Lewis said dash cam footage from the incident doesn't show the entire story, however. According to Lewis, the deputy who fired at the suspect tried saving that suspect's life.

"He goes up and he starts to perform CPR and first aid on the guy who he just shot," Lewis explained. "That's a mindset that you can't teach. He stepped up and tried to save that man's life."

"I'm very pleased that the investigation concluded that we followed all protocol and policies," said Lewis. "We're so very sorry that they lost a family member and it's unfortunate that it came to be in such a way. Our thoughts and prayers are continuously with them."
